Terms of Use

• "User" / "You" / "Your" means any individual or organisation accessing or using the Portal, including authorised representatives of organisations.
• "Authorised User" refers to an individual nominated by an organisation through a valid User Authorisation Letter for the purpose of accessing and using the Portal on behalf of the organisation.
• "Stakeholder" means government agencies, PSUs, OEMs, suppliers, distributors, service providers, project developers, and other entities engaged in the green hydrogen ecosystem.
• "Content" refers to any data, information, text, graphics, documents, listings, or other materials submitted, uploaded, or displayed on the Portal by Users or by us.

• Only bona fide organisations and their duly authorised representatives may register and use the Portal.
• Users must be at least 18 years old and legally capable of entering into binding contracts.
• Registration is subject to submission of a valid User Authorisation Letter on official letterhead, signed and stamped by a competent authority.

• Each organisation must designate one or more Authorised Users who will act as primary points of contact.
• You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.
• You must ensure that all information provided during registration and thereafter is true, accurate, and kept up to date.
• You agree to immediately notify us of any unauthorised use of your account or breach of security.

The Portal is provided for the purpose of enabling stakeholders in India's Green Hydrogen ecosystem to:

• Showcase products, services, and capabilities through marketplace listings.
• Collaborate with other stakeholders via communication tools and shared resources.
• Access information, knowledge hubs, and project development tools.
• Promote indigenous technologies and support the National Green Hydrogen Mission.

You agree to use the Portal only for lawful, bona fide business purposes related to the green hydrogen ecosystem.

You shall not:

• Impersonate any person or entity or misrepresent your affiliation.
• Upload or transmit any false, misleading, defamatory, obscene, or unlawful content.
• Upload viruses, malware, or engage in activities that disrupt or interfere with the Portal's operation.
• Use the Portal for spamming, phishing, unauthorised marketing, or data scraping.
• Reproduce, copy, sell, or exploit any portion of the Portal for commercial gain unrelated to the intended purpose.
• Attempt to gain unauthorised access to any systems, data, or other user accounts.

Any violation of the above may result in suspension or termination of your access without notice.

• You retain ownership of the content and information you submit to the Portal. By uploading, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content for the functioning of the Portal.
• You are solely responsible for ensuring that the content you submit is accurate, lawful, and does not infringe upon third-party rights.
• We reserve the right to review, moderate, or remove any content at our discretion that violates these Terms or applicable law.

• All intellectual property rights in the Portal, including design, graphics, software, logos, trademarks, and content developed by us, are owned by or licensed to Excelvate Systems Pvt. Ltd.
• You are granted a limited, non-transferable, non-exclusive license to access and use the Portal for its intended purpose.
• You must not reproduce, modify, distribute, or exploit any part of the Portal without prior written permission.

Your use of the Portal is also governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using the Portal, you consent to the processing of your information in accordance with the Privacy Policy.

• We strive to provide uninterrupted access to the Portal, but we do not guarantee that the Portal will always be available, error-free, or secure.
• We may, at any time and without prior notice, modify, suspend, or discontinue any part of the Portal for maintenance, upgrades, or other operational reasons.
• We reserve the right to modify these Terms from time to time. Updated Terms will be posted on the Portal with a revised "Last Updated" date. Continued use constitutes acceptance of the updated Terms.

The Portal and its services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, including but not limited to:

• Accuracy, completeness, or reliability of content.
• Suitability of the Portal for your specific purposes.
• Continuous, secure, or error-free access.

Your use of the Portal is at your own risk.

To the maximum extent permitted by law, Excelvate Systems Pvt. Ltd. shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from:

• Use or inability to use the Portal.
• Unauthorised access to or alteration of your data.
• Any content or conduct of third parties on the Portal.
• Business losses, lost profits, or loss of data.

You agree to indemnify and hold harmless Excelvate Systems Pvt. Ltd., its directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, or expenses arising out of your:

• Use or misuse of the Portal.
• Violation of these Terms.
• Infringement of any third-party rights or applicable laws.

We may suspend or terminate your access to the Portal at any time, with or without notice, if:

• You violate these Terms or applicable law.
• You submit false or misleading information.
• Required by legal or regulatory authorities.

Upon termination, your right to use the Portal ceases immediately. Provisions relating to intellectual property, limitation of liability, and indemnification will survive termination.

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nagpur, Maharashtra.
